1. Scope and data controller
This Privacy Policy describes how Datoluxo SpA (hereinafter "Datoluxo"), with registered address at Av. Apoquindo 4001, Office 1502, Las Condes, Santiago, Chile, Tax ID 77.234.567-8, collects, uses, stores, and protects the personal data of users of the datoluxo.com platform. Datoluxo acts as the data controller in accordance with Law 19,628 on the Protection of Private Life and Law 21,719 on Personal Data Protection of Chile.
2. Personal data we collect
We collect the following types of personal data: (a) Identification data: full name, Tax ID (RUT), date of birth, nationality; (b) Contact data: email address, phone number, postal address; (c) Financial data: banking information necessary to process investments and profit distributions; (d) Browsing data: IP address, browser type, pages visited, time spent on the platform; (e) Data voluntarily provided through contact forms or direct communications with our team.
3. Purpose of data processing
Your personal data is processed for the following purposes: management of your user account on the platform; processing and administration of investments in real estate projects; compliance with legal and regulatory obligations before the Financial Market Commission (CMF) and other Chilean authorities; sending communications related to your investments and the operation of the platform; continuous improvement of our services and user experience; fraud prevention and compliance with anti-money laundering regulations.
4. Legal basis for processing
The processing of your data is based on: consent given when registering and using the platform; execution of the participation contract in crowdlending projects; compliance with legal obligations established by Chilean legislation, including CMF regulations; and Datoluxo's legitimate interest in improving its services and ensuring platform security.
5. Data sharing with third parties
Datoluxo may share your personal data with: developers and managers of the real estate projects in which you invest, to the extent strictly necessary; financial institutions for transaction processing; regulatory and tax authorities when required by law; technology service providers that assist in the operation of the platform, subject to confidentiality and data protection agreements. Under no circumstances will we sell your personal data to third parties for commercial purposes unrelated to the operation of the platform.
6. International data transfers
In the event that your data is transferred outside of Chile, Datoluxo guarantees that such transfers will comply with the protection standards established by Chilean legislation, implementing the appropriate contractual and technical safeguards to protect the integrity and confidentiality of your personal information.
7. Retention period
Your personal data will be retained for as long as you maintain an active account on the platform and, subsequently, for the periods required by applicable Chilean regulations, including tax and CMF obligations. Data associated with investments will be retained for a minimum of ten years from the settlement of the corresponding project.
8. Your rights as a data subject
Under current Chilean legislation, you have the right to: access your personal data held by Datoluxo; request the rectification of inaccurate or incomplete data; request the deletion of your data when it is no longer necessary for the purposes for which it was collected; object to the processing of your data in certain circumstances; request the portability of your data to another data controller. 9. Security measures
Datoluxo implements appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. Datoluxo reserves the right to update this Privacy Policy. Changes will be notified through the platform and/or by email. Continued use of the platform after the publication of changes constitutes acceptance of the modified policy.
